ISDSS™ Terms of Use

1. Who we are and what these Terms cover

These Terms of Use (Terms) are an agreement between you and The Knights of Safety Limited, registered in England and Wales under company number 07520728, with its registered office at 1 Worsley Court, High Street, Worsley, Manchester, M28 3NJ (we, us or our).

These Terms govern your access to and use of ISDSS™ (International Safety Data Sheet Service), including its website, accounts, Personal Library, Safety Data Sheet (SDS), Chemical Risk Assessment (CRA), search, download and related features (the Service).

By creating an account or using the Service, you agree to these Terms. If you use the Service for an organisation, you confirm that you have authority to accept these Terms for that organisation. If you do not agree, do not use the Service.

Our Privacy Policy explains how we use personal data. Our Cookie Policy explains the technologies used on the website.

2. About the Service

The Service helps users search for, access, organise and manage SDSs, CRAs and related workplace-safety information. It is intended to support workplace safety and chemical-management activities. It does not replace the duties of employers, suppliers, competent persons or other responsible parties under applicable law.

3. Eligibility and accounts

You must be at least 18 years old and legally capable of entering into these Terms. You must provide accurate information, keep it current and protect your login credentials.

You are responsible for activity through your account unless you notify us without unreasonable delay that it has been accessed without your authority. You must not impersonate another person, create an account using misleading information, share credentials or allow another person to use your account.

Contact us promptly if you believe your account or credentials have been compromised.

4. Permission to use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable permission to access and use the Service for its intended purpose.

This permission does not transfer ownership of the Service, its software, branding, databases or original content. Those rights remain with us or our licensors.

5. Safety Data Sheets and third-party content

SDSs and other third-party materials available through the Service are generally created and owned by manufacturers, suppliers or other rights holders. They remain subject to any copyright, database right, trade mark, licence and other rights that apply to them.

Access through the Service does not mean that third-party content is in the public domain and does not grant you a right to reproduce, republish, redistribute, modify, sell, license or commercially exploit it. You may use or share third-party content only where the rights holder permits it, the applicable licence allows it or the law otherwise permits it.

We do not grant an open licence over manufacturer SDSs or other third-party content. Any licence stated for ISDSS-created metadata or other original material applies only to the material and scope expressly identified and does not cover third-party documents.

6. Your content

You retain any rights you hold in original content you submit to the Service. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process and display that content only as reasonably necessary to provide, secure, maintain and improve the Service.

You confirm that you have the rights and permissions needed to submit the content and that doing so does not infringe another person's rights or break the law.

7. Acceptable use

You must use the Service lawfully and must not:

  • Interfere with or disrupt the Service, its systems or users.
  • Gain or attempt to gain unauthorised access to accounts, systems or data.
  • Bypass authentication, access controls, rate limits or security measures.
  • Probe or test security without our prior written permission.
  • Introduce malware, harmful code or unlawful content.
  • Scrape, crawl, harvest, bulk-download or systematically extract content or data without our prior written permission.
  • Use bots, scripts, agents or other automated means to interact with the Service without our prior written permission.
  • Reverse engineer, decompile or attempt to discover source code except where applicable law expressly permits it.
  • Infringe intellectual-property, privacy or other rights.
  • Use the Service in a way that creates an unreasonable security, legal or operational risk.

We may apply reasonable limits to searches, downloads, requests and other activity to protect the Service and ensure fair access. Organisations needing higher-volume or automated access should contact us to discuss appropriate arrangements.

8. Service changes and availability

We aim to provide a reliable Service but do not promise uninterrupted or error-free availability. Maintenance, updates, security work, infrastructure failures and events outside our reasonable control may affect it.

We may change, add, remove, suspend or discontinue features. Where reasonably practicable, we will give advance notice of a material change that significantly affects registered users.

9. Personal Library and records

The Personal Library is a convenience for organising supported documents and information. It is not your sole record-keeping, compliance or backup system.

You are responsible for maintaining independent copies of SDSs, CRAs and other records needed by you or your organisation. Library content may become unavailable because of user action, account closure, maintenance, faults, security incidents, third-party failures or other causes.

Closing or terminating an account may result in library content being deleted after an appropriate retention period, subject to legal, security and dispute-resolution requirements described in our Privacy Policy.

10. Artificial intelligence and beta features

The Service may include artificial-intelligence, machine-learning, automated, preview or beta features. Outputs may be incomplete, inaccurate or unsuitable for your circumstances.

AI-generated or automated material is an aid only and is not a substitute for a manufacturer's current SDS, a workplace risk assessment, legal or regulatory advice, professional safety advice or the judgement of a competent person. You must review and verify outputs before relying on them.

Beta or preview features may change, contain defects or be withdrawn without notice. Use of those features is voluntary.

11. Security and responsible disclosure

If you believe you have found a security vulnerability, report it to contact@thechemicalsafetyassociation.org. Act in good faith, avoid accessing or altering data that is not yours, do not disrupt the Service and give us a reasonable opportunity to investigate before public disclosure.

This section does not authorise security testing. Testing requires our prior written permission.

12. Suspension and termination

We may restrict, suspend or terminate access where we reasonably believe that an account has been compromised, these Terms have been breached, use is unlawful, or continued access presents a security, legal or operational risk.

Where appropriate, we will give notice and an opportunity to address the issue. We may act immediately where reasonably necessary to protect users, systems, data or third parties, or to comply with law.

You may stop using the Service and request account closure at any time. Termination does not affect rights and obligations that arose before termination.

13. Important information about SDSs, CRAs and other content

We take reasonable care in operating the Service, but third-party SDSs and other content may be incomplete, outdated, inaccurate, unavailable or unsuitable for a particular product, workplace or jurisdiction. We do not create, verify, approve or certify a manufacturer's SDS unless we expressly say otherwise.

You are responsible for checking that you have the correct and current SDS for the exact product and supplier, and for meeting applicable workplace-safety, chemical-management and regulatory duties. Where necessary, obtain the document directly from the manufacturer or supplier.

Nothing in the Service is legal, regulatory, scientific, medical or professional safety advice.

14. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

If you use the Service as a consumer, your statutory rights are not affected. We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill, but not for loss that was not foreseeable.

If you use the Service for business purposes, then, to the fullest extent permitted by law:

  • The Service is provided as available, without implied warranties that may lawfully be excluded.
  • We are not liable for loss of profit, revenue, business, opportunity, anticipated savings or goodwill, or for indirect or consequential loss.
  • We are not liable for loss, corruption or unavailability of Personal Library content where the loss could reasonably have been avoided by maintaining an independent copy.

Nothing in this section limits any responsibility that cannot legally be limited or excluded.

15. Privacy

Our Privacy Policy explains how we collect, use, share and retain personal data and how you may exercise your data-protection rights.

16. Changes to these Terms

We may update these Terms to reflect legal, security, operational or Service changes. The Last updated date shows when they were most recently revised.

Where a change materially affects registered users, we will take reasonable steps to give notice before it takes effect. If you do not agree to revised Terms, you must stop using the Service and, where applicable, close your account.

17. Governing law and courts

These Terms are governed by the law of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory protections available under the law of your place of residence and may be entitled to bring proceedings in your local courts. In other cases, the courts of England and Wales have exclusive jurisdiction, except where applicable law requires otherwise.

18. General terms

These Terms and the documents expressly referred to in them form the agreement concerning use of the Service. If a provision is found invalid or unenforceable, the remaining provisions continue to apply.

A delay in enforcing a right does not waive it. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours as part of a merger, acquisition, restructuring or sale, provided this does not reduce protections that cannot lawfully be reduced.

Provisions which by their nature continue after termination, including those concerning intellectual property, third-party content, liability, governing law and accrued rights, will survive termination.
